The Port Health Services is responsible for import controls on tobacco, tobacco-related products and electronic cigarettes entering Malta from countries outside of the European Union (EU) (third countries).
Importers of tobacco products, herbal products for smoking, electronic cigarettes and refill containers are required by SL 315.10 to notify the competent authority on their intention of placing such products on the national market before making them available for sale.
Products imported shall only be placed on the market if they comply with S.L. 315.10 – Manufacture, Presentation and Sale of Tobacco and Related Products Regulations, of the Laws of Malta. These regulations transpose the Tobacco Products Directive 2014/40/EU in Malta.

*Cross-border distance sales of tobacco products, herbal products for smoking, and both nicotine and non- nicotine containing electronic cigarettes/refill containers, or any component of that product to consumers located in Malta is prohibited.
