Manufacturers and importers of tobacco products, herbal products for smoking and electronic cigarettes and refill containers are required by SL 315.10 to notify the competent authority on their intention of placing such products on the national market before making them available for sale.

The Superintendent for Public Health is the Maltese designated competent authority for the management and publication of notifications for these products. 

The list on our website does not represent an authorisation but a notification by the manufacturer/importer. Article 23 of S.L.315.10 provides that the obligation to provide complete and correct information “shall lie primarily with the manufacturer, if the manufacturer is established in Malta. The obligation to provide the requested information shall lie primarily with the importer if the manufacturer is established outside Malta and the importer is established inside Malta.”

If any of the information requested under Article 18 (2)(b) of S.L.315.10 is missing, including “the declaration that the manufacturer and importer bear full responsibility…”, the notification would be considered incomplete and invalid. Products found on the market without a valid notification will be seized, without prejudice to the taking of any proceedings against the person responsible for the offence.
