Cross-border Distance Sales of Tobacco Products

Businesses intending to engage in cross-border distance sales of tobacco products and/or e-cigarettes must register with the Superintendent of Public Health. Such businesses include:

those established in Malta selling tobacco products and/or e-cigarettes to consumers in another EU country.

Cross-border distance sales of tobacco products, herbal products for smoking, and both nicotine and non- nicotine containing electronic cigarettes/refill containers to consumers located in Malta shall be prohibited.

Businesses established in Malta selling to consumers residing within an EU must member state must also register with the competent authority in the member state where the actual or potential consumers are located. Proof of such registration must be attached with the registration form.

Businesses may only supply the relevant product to a consumer via cross-border distance sales after they have received confirmation of their registration with the Superintendent of Public Health.

This does not apply to business to business sales i.e. sales not direct to consumers.

The Superintendent of Public Health will confirm registrations once these, and any accompanying documents, have been verified as correct.

The Superintendent of Public Health will publish the list of registered retailers on this website. In case of changes of the registered information, the registered party is obliged to inform the Superintendent of Public Health.

Business engaging in cross-border distance sales of tobacco products may not supply such products to consumers in EU Member States where cross-border distance sales of tobacco products has been prohibited.
